1. Acceptance of Terms

Welcome to TextPixAI.

These Terms and Conditions (“Terms”) govern your access to and use of the TextPixAI website located at https://textpixai.com, together with any applications, software, tools, features, content and services made available through the platform (collectively, the “Services”).

TextPixAI provides artificial intelligence based tools that may include, but are not limited to, text generation, writing assistance, image generation, text to speech, speech to text, transcription, content enhancement and other AI powered services.

By accessing or using TextPixAI, creating an account, purchasing a subscription or using any of our Services, you confirm that you have read, understood and agreed to be bound by these Terms.

If you do not agree to these Terms, you must not access or use TextPixAI.

You must not use TextPixAI to:

2. Commit, facilitate or promote fraud, deception or other unlawful activities.
3. Generate, upload, distribute or promote content that infringes copyright, trademarks, patents, privacy rights, publicity rights or other intellectual property rights.
4. Generate or distribute content intended to facilitate serious wrongdoing or illegal activities.
5. Attempt to gain unauthorised access to TextPixAI, its servers, systems, databases or accounts.
6. Introduce malware, viruses, malicious code or other harmful software.
7. Interfere with or disrupt the operation, security or availability of the Services.
8. Use bots, crawlers, scripts, scraping tools or other automated methods to access the Services without our prior written permission.
9. Circumvent usage limits, subscription restrictions, security measures or other technical controls.
10. Reverse engineer, decompile or attempt to extract the source code of the platform except where such activity is expressly permitted by applicable law.
11. Resell, sublicense or commercially redistribute access to the Services without our prior written authorisation.
12. Use the Services to impersonate another person or organisation for fraudulent or deceptive purposes.
13. Use generated content to mislead people about whether it was created, verified or endorsed by a particular person or organisation.
14. Upload content that you do not have the legal right to use.
15. Use TextPixAI in a manner that could damage the reputation, security or operation of the platform.

We may remove content, restrict functionality or suspend accounts where we reasonably believe that the Services are being misused.

6. User Content

“User Content” means text, documents, images, audio, video, prompts, instructions or other materials that you upload, submit or provide to TextPixAI.

You retain ownership of your User Content, subject to any rights belonging to third parties.

By submitting User Content to TextPixAI, you grant us the limited rights reasonably necessary to process, store and transmit that content in order to provide the Services to you.

You are solely responsible for ensuring that you have the necessary rights, permissions and legal authority to submit User Content to TextPixAI.

You must not upload confidential, sensitive or personal information belonging to another person unless you have the necessary legal authority or permission to do so.

7. AI Generated Content

TextPixAI may generate text, images, audio, transcriptions or other material based on information and instructions provided by users.

AI generated content may contain errors, inaccuracies, omissions, biases or inappropriate information.

AI generated content should therefore be reviewed and independently verified before being relied upon, published, distributed or used for important decisions.

TextPixAI does not guarantee that generated content will be:

1. Accurate.
2. Complete.
3. Original.
4. Suitable for a particular purpose.
5. Free from errors.
6. Free from third party intellectual property claims.
7. Appropriate for every intended use.

You are responsible for reviewing and determining whether generated content is appropriate for your intended use.

8. Ownership of Generated Content

To the extent permitted by applicable law, you may use content generated through TextPixAI for lawful personal or commercial purposes, subject to these Terms and any restrictions imposed by applicable third party AI providers.

However, ownership and copyright protection of AI generated material may vary depending on the applicable law and the extent of human contribution to the work.

TextPixAI does not guarantee that every AI generated output is capable of being protected by copyright or that you will have exclusive rights over an output.

Similar or identical outputs may also be generated for other users.

You are responsible for determining whether your intended use of generated content complies with applicable intellectual property laws.

9. Intellectual Property Owned by TextPixAI

Unless otherwise stated, TextPixAI and its licensors retain all rights, title and interest in the TextPixAI platform, including its software, interface, branding, logos, designs, website structure, documentation and proprietary technology.

Nothing in these Terms grants you ownership of TextPixAI’s intellectual property.

You may not copy, reproduce, modify, distribute, sell, lease, license or create derivative works from TextPixAI’s proprietary materials without our prior written permission.

10. Third Party Services and AI Providers

15. Disclaimer of Warranties

To the maximum extent permitted by applicable law, TextPixAI is provided on an “as is” and “as available” basis.

We make no warranties or guarantees, express or implied, regarding the Services, including their accuracy, reliability, availability, fitness for a particular purpose, non-infringement or suitability for your particular requirements.

We do not guarantee that AI generated content will always be accurate, reliable, complete or suitable for a particular purpose.

16. Limitation of Liability

To the maximum extent permitted by applicable law, TextPixAI and its owners, operators, affiliates, employees, contractors, licensors and service providers shall not be liable for indirect, incidental, special, consequential or punitive damages arising from or relating to your use of the Services.

This includes, where permitted by law, loss of profits, revenue, data, business opportunities or reputation.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

17. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless TextPixAI and its owners, operators, employees, contractors and service providers from claims, damages, liabilities, losses and expenses arising from:

3. Your User Content.

5. Your misuse of AI generated content.

18. Account Suspension and Termination

We may suspend, restrict or terminate your access to TextPixAI where we reasonably believe that you:

2. Have engaged in fraudulent or abusive activity.
3. Have attempted to compromise the security of the Services.
4. Have used the Services unlawfully.
5. Have attempted to circumvent usage or payment restrictions.

Where appropriate, we may provide notice before taking action. However, immediate suspension or termination may be necessary in circumstances involving security risks, fraud, unlawful activity or serious violations.
